Subject: Objection to the Records Request Extention
Dear Attorney General,
The Alaska Democratic Party strongly objects to the most recent records extension request dated October 14, 2009.
There is no credible explanation as to why this is taking so long, since the request at issue was narrow in its scope. Each requested item involves former Governor Sarah Palin as either the sender of or the recipient of the e-mails in question, together with former Governor Sarah Palin’s schedules, calendars, and itineraries.
During the time periods specified, how many e-mails could former Governor Palin have possibly sent to or received from John Coghill. Fred Dyson, Todd Palin, and Molly McCann with the words listed in the request; or other e-mails sent from former Governor Palin with the words listed in records request? This is not conceivably a massive volume of documents. There are computer search functions that can readily assist with finding the e-mails in question. Again, all of the e-mails in question had to involve former Governor Palin as either the sender or recipient, and include one or more of the specified words. This is a definable, limited number of documents.
It has now taken over a year for the State of Alaska to retrieve and review a very finite number of documents. This is simply unacceptable and unwarranted. As we have noted earlier, to function properly, our democracy requires access to government documents in a timely manner. To grant an additional extension would do a disservice to the fundamentals of open government. In this case, certainly, justice delayed is justice denied; and a further delay clearly continues to undermine the intent of the Alaska Public Records Act.
The reasons presented in the Department of Law’s Memorandum do not provide an adequate or acceptable rationale for further delay. We ask you to take a hard, fresh look at our original, narrowly defined request, and conclude that there is no basis for an additional extension.
Accordingly, we urge you to deny any further extensions.
Thank you.
